Accent Alaska Photographer Contributor Agreement

1. By submitting photographs to Accent Alaska, the photographer authorizes the marketing, sale, reproduction, and publication of submitted photographs, whether by negative, transparency or digital formats, in whole or in part, in any form, without restriction, subject to payment of scheduled fees, and affirms that the submissions:
• are copyrighted absolutely to the photographer;
• were not taken in violation of law; and
• include no recognizable images of persons or property for which consent for publication has not been granted when consent is necessary.
The photographer agrees to hold harmless and indemnify Accent Alaska from claims by persons who dispute the photographer’s ownership or who claim damage or loss from the photographer’s taking, use, or submission of the photograph.

2. The photographer agrees that marketing, sales, and promotion will be at the discretion of Accent Alaska; that any submissions may be used by Accent Alaska for sales, marketing, and promotional purposes; and that the use or sale of any submission cannot be guaranteed and is subject to the competitive and seasonal nature of the industry.

3. To avoid confusion or use infringement, the photographer agrees to notify Accent Alaska immediately upon authorizing any independent corporate, advertising or editorial sale or use of photographs submitted to Accent Alaska.

4. Accent Alaska will take reasonable care to avoid tangible and intangible loss or damage to photographic submissions, and the photographer agrees that Accent Alaska is not liable for loss or damage, however caused, to transparencies, negatives, or prints in possession of, or in transit to or from Accent Alaska.

5. Clients of Accent Alaska who cause tangible or intangible damage or loss will be charged a minimum of $1500.00 per image pursuant to the Accent Alaska Client Agreement.

6. Accent Alaska will pay to the submitting photographer 50% of all fees (usage fees, reuse fees, and loss or damage fees) upon collection from the client.
